The Polish Battery Law (Dz. U. 2009 Nr 79 poz. 666) regulates the marketing, return and environmentally sound disposal of batteries and accumulators.


Manufacturers and importers of portable batteries are obliged to:

  • Funding the collection and recycling of used batteries
  • Reporting the amount of goods placed on the market and the amount collected and recycled to the Waste Database, BDO)
  • Funding of environmental education

Why do batteries need to be recycled?

Batteries and accumulators contain valuable raw materials, but sometimes also hazardous substances that can harm the environment. To prevent this and to be able to recover secondary raw materials, old and defective batteries must be disposed of separately. From the designated collection points in retail, municipalities and trade, the batteries are first sorted and then recycled.

What is the responsibility of ERP Polska?

ERP Polska Organizacja Odzysku SEiE i Organizacja Odzysku Opakowań S.A, is engaged in waste management projects. ERP Polska's activities include collection, processing, recycling and disposal of waste equipment, packaging waste and batteries and accumulators. ERP Polska offers comprehensive services to Polish and foreign manufacturers, importers, distributors and introducers of electronic equipment, packaging and batteries, and acts as an Authorized Representative for entrepreneurs based outside the country. ERP Polska's activities help meet statutory requirements for managing waste equipment, batteries and packaging waste.

What is ERP Polska's activities in the circular economy?

A circular economy is a production and consumption model that seeks to make rational use of resources and minimize negative environmental impacts. Under GOZ, materials and raw materials should remain in circulation as long as possible, and waste generation should be minimized. In Poland, we generate 120 million tons of waste annually, so the introduction of GOZ is important. In 2019, the Council of Ministers adopted the "Roadmap for Transformation to a Closed Cycle Economy." Valuable activities include remanufacturing, renewable energy and waste minimization what ERP Poland is doing as part of its activities. It is worth noting that the EU is also supporting the transition to circular economy through the so-called "Waste Package," an amendment to directives on waste management.

What is a product fee?

The product fee applies to entrepreneurs who market SEiE, packaging or packaged products, batteries and accumulators in Poland. In practice, this means that manufacturers, importers, online retailers, exporters, recovery organizations and catering establishments are subject to the fee. Its purpose is to promote the recycling and recovery of packaging to protect the environment from pollution. In practice, the product fee is a penalty for failure to fulfill the introducer's statutory obligations to organize collection, recycling, conduct public education campaigns and report to the Marshal's Office. The amount of the product fee depends on the type and weight of products introduced into the market. The obligation to pay the fee arises at the end of the calendar year, and the due date is March 15 of the year following the year to which the product fee applies.

What is the BDO (Baza Danych o Odpadach)?

The BDO is a government database. All manufacturers as defined by the Battery Law must register with the BDO before placing batteries or accumulators on the market. Once per year (before March 15) producers file a report with BDO.

What is the BDO number?

The BDO number is the assigned registration number that serves as proof of the registration of the manufacturer, the brand and the type of electrical or electronic equipment carried out in the country of manufacture. It thus simultaneously serves to identify the manufacturer, and must be displayed on invoices.

What are the obligations of manufacturers?

Manufacturers placing portable batteries on the market are obliged to organize and finance collection and recycling of waste batteriers. Before placing batteries on the market, producers must register with BDO, stating the brand and the respective battery type. The Battery Law obliges manufacturers of portable batteries to organize collection and recycling of used batteries, or else contract an intermediary who will organize the proper and environmentally sound collection and recycling of spent batteries at the expense of the manufacturer.
Manufacturers must also conduct environmental education campaigns.
Requirements listed above apply also to manufacturers, who place on the market portable batteries contained in the equipment.

Assumption of Obligations: According to the regulations, the ROP can take over from the entrepreneur the obligation to recover and recycle waste (equipment, batteries, packaging). The entrepreneur, after signing an agreement using the Click & Comply service, provides ERP Poland with information on the weight of products placed on the market. On this basis, the recovery organization ensures fulfillment of the obligation, cooperating with certified recyclers and processing plants.


Cooperation in ROP systems: In most EU countries, including Poland, ROP is implemented through so-called ROP systems. These systems are a collection of companies and institutions that jointly implement and carry out ROP policies. One of the most important players are recovery organizations including ERP Poland, which work to maximize recycling levels and close raw material cycles.
